2.This action is to clear
title pursuant to RPAPL
ß1515 to the Boat Berth
which Plaintiff has exclusively used for more than
37 years.
3.In addition, this action
seeks to claim a right of adverse possession to the Boat
Berth property, pursuant to
RPAPL Article 15.

the Boat Berth
4.On July 23, 1978, 91
East Riviera Drive was purchased by Plaintiff and Bruce
Kay (ìDecedent Partnerî)
from Miguel and Delores
Broullon. Exhibit ìAî is the
chain of title search of MKM
Abstract Company dated
November 1st, 2017.
5.The Plaintiff ’s Deed
states that the Plaintiff and
the Decedent Partner were
the fee title owners of 91
East Riviera Drive, known
and designated as Lots 1 to
4 inclusive and 11 and 12 in
Block 23 on a certain map
entitled, ìMap of American
Venice, Amended, Section
1î, filed in the office of the
Clerk of the County of Suffolk on January 27, 1926 as
Map No. 224.
6.In addition, Plaintiff ’s
Deed stated that they owned
exclusive use of a strip of

land bounded and described
as the Boat Berth, Riviera
Drive, Lindenhurst, New
York, District 011, Section
190.00, Block 04.00, Lot
001.000, more particularly
described as follows:
ALL that certain plot,
piece or parcel of land, together with the buildings
and improvements thereon
erected, situate at Copiague,
Town of Babylon, County
of Suffolk and State of New
York, being a portion of a
strip and land lying between
Canal Grande on the west
and Riviera Drive East on
the east, Map of American
Venice, Amended Section
1, filed in the Suffolk County
Clerk’s Office on January 27,
1926 as Map Number 224,
which portion of said strip
of land herein described is
bounded on the north by
the extension westerly in a
straight line of the northerly line of Lot Number 1 in

Sole Ownership by Plaintiff7.On April 10, 1980, the
Plaintiff bought out his Decedent Partner’s interest in
the property from Roger
Kay as Administrator of
the Estate of Bruce R. Kay
(ìAdministratorî) and Anita
Garite. Exhibit ìAî includes
the April 10, 1980 deeds.
Exclusive Ownership
and Possession of the Boat
Berth
8.Between July 23, 1978
and April 10, 1980, Plaintiff
and his Decedent Partner
(or his Administrator) were
the exclusive owners in fee
and in actual exclusive possession of 91 East Riviera
Drive and in exclusive possession of the Boat Berth.
9.Since April 10, 1980,
the Plaintiff has been the
exclusive owner in fee and
in actual exclusive possession of 91 East Riviera Drive
and in exclusive possession
of the Boat Berth.
Adverse Possession
10.Since July 23, 1978,
Plaintiff in title has been
in actual possession of the
Boat Berth under a claim
of title, has held the same

exclusive of any other right
under written instrument
and has been in hostile, open
and notorious and actual
possession of the Premises
continuously for more than
ten (10) years prior to the
commencement of this action, and such possession
continues to the present
time.
11.Since July 23, 1978,
Plaintiff has been under the
impression that the Boat
Berth was part and parcel of
those lands and that fee title
was conveyed to Plaintiff.
12.Since July 23, 1978,
Plaintiff has cultivated, or
improved the Boat Berth
premises and has protected
the Boat Berth premises
with an enclosure.
13.Since July 23, 1978,
Plaintiff has maintained the
Boat Berth in the following
ways:
a.Plaintiff paid the real estate taxes on the Boat Berth
since 1978. The tax bill is
in the Plaintiff’s name and
sent to the Plaintiff ’s house.
Exhibit ìCî is the tax bill for
91 91 East Riviera Drive and
the Boat Berth;
b.Plaintiff paid the mortgage and utilities associated
with the Boat Berth;
c.Plaintiff enclosed the
Boat Berth with a fence;
d.Plaintiff stored materials and boats on the Boat
Berth;
e.Plaintiff watered, mowed
and maintained the lawn and
planted grass and bushes on
the Boat Berth;
f.Plaintiff docked boats
and tied them to the Boat
Berth;
g.Plaintiff openly used and
enjoyed the Boat Berth.
Title to the Boat Berth
14.This action was precipitated by the Plaintiff ’s
contemplated sale of 91 East
Riviera Drive, including the
Boat Berth.
15.In preparation for sale,
Plaintiff ’s attorney, Gerard
Glass, Esq., reviewed and
ordered a title search.
16.The title search revealed that the above title
to the Boat Berth in fee
was owned by deed from
Defendants, Vito Palazzolo
and Elayne Palazzolo (the
ìPalazzolosî), who previously owned 91 East Riviera
Drive, Lindenhurst, which
Deed was last recorded on
March 8, 1966 in Liber 5921
Cp. 561. Exhibit ìAî contains the Deed. Exhibit ìDî
is the title company’s last
owner search.
Other Interested Parties

17.The Palazzolos are interested parties who may
claim to have some estate or
interest in the disputed Boat
Berth area described above,
which belongs to Plaintiff.
18.It is obvious the Palazzolos intended to convey
title to 91 East Riviera Drive,
Lindenhurst and the Boat
Berth. But did not by mistake. 19.However, the Palazzolos have not made such
claim, nor have they ever
had any contact with the
Plaintiff.
20.Indeed, the Palazzolos
cannot be located and are
believed to be deceased.
21.Based on the public
records from the chain of
title search, the Palazzolos
are the only parties that
might have a claim on the
estate, or interest in the real
property which is the subject
of this litigation, and that is
extremely unlikely.
22.No personal claim is
made against any third party
herein upon any cause of action brought under Article
15 of the RPAPL, except
such parties as may assert a
claim adverse to the claim
of the Plaintiff as set forth
herein.
23.Upon information and
belief, none of the parties
interested in this action are
infants, mentally retarded,
mentally ill, or alcohol abusers. 24.That no persons other
than the Plaintiff have been
in actual possession of the
real property during the
past 10 years claiming title
as owners in fee.
25.That the Court should
order service by publication
since the Palazzolos cannot
be located and are most
likely deceased.
26.Plaintiff has no adequate remedy at law.
27.No previous application has been made to this
or any other Court for this or
any other similar relief.
WHEREFORE, the Plaintiff prays for an order declaring that the fee title of the
Plaintiff to the above described real property known
as the ìBoat Berthî has been
judicially established free
and clear of any liens, other
than those which the Plaintiff may have caused, and
granting such other and
further relief as to the Court
may seem just and proper;
and
WHEREFORE, the Plaintiff prays that the Palazzolos
and all persons that may

claim under them, be forever barred from all claim

ADOPTING LOCAL LAW
NO. 19 OF 2018 AMENDING CHAPTER 213, ARTICLE XVIII, OF THE
BABYLON TOWN CODE
(Supplementary Regulations) WHEREAS, the Town Board
of the Town of Babylon having duly called and held a
Public Hearing at Babylon
Town Hall, 200 East Sunrise
Highway, Lindenhurst, New
York, on the 11th day of July
2018 upon the question of
enactment of Local Law
No. 19 of 2018 of the Town
of Babylon, Suffolk County,
New York, being a Local Law
amending the Code of the
Town of Babylon, Chapter
213;
NOW, THEREFORE, be it
RESOLVED AND ORDAINED, by the Town Board
of the Town of Babylon that
Local Law No. 19 of 2018, of
the Town of Babylon, Suffolk
County, New York, is hereby
enacted as follows and effective upon its filing with the
New York State Department
of State:

Amend:
Section 213-250.3 Objects
Affecting Navigable Airspace 1.Within a runway protection zone (RPZ), no building
or structure shall be constructed, nor any improvement added to an existing
building or structure, until
such building, structure or
improvement is determined
by the Federal Aviation Administration (FAA) not to
be a hazard to aerial navigation. 2.No building permit or
other license or permit shall
be issued for any construction subject to this section
until a determination of no
hazard to air navigation,
or the equivalent of such
determination, has been

issued by the FAA covering
the proposed construction.
Any permits issued for such
construction shall be conditioned upon the construction, including temporary
construction equipment
such as cranes and derricks
remaining within the height
limits of the plans submitted
to the FAA, and upon compliance with any lighting
or marking requirements
specified by the FAA.

OF TOWN OWNED PROPERTY LOCATED AT

WHEREAS, the Town of
Babylon has declared certain town-owned property located at SCTM No.
0100-201.00-01.00-066.002,
further described on the
attached Schedule “A” and
identified as the “Premises”,
to be surplus because same
is no longer needed for any
town purpose; and
WHEREAS, 515 Jackson
Ave, LLC has made an offer
to the Town, based on an
appraisal, for the purchase
of the Premises to be used
in conjunction with his adjoining multiple residence
project located adjacent to
the Premises.
NOW, THEREFORE, be it
RESOLVED, that the Town
Board of the Town of Babylon convey to the aforementioned 515 Jackson Ave,
LLC, the Premises described
in the attached Schedule “A”
for a total consideration of
Four Thousand Eight Hundred ($4,800.00) Dollars;
and be it further
RESOLVED, that the Supervisor be and is hereby

authorized to execute a
quitclaim deed and other
related documents for the
aforementioned transfer;
and be it further
RESOLVED, that this resolution is subject to a permissive referendum and
the Town Clerk is hereby
directed to publish notice of
the adoption of this resolution in an official newspaper
of the town.
