NOTICE OF ADOPTION OF RESOLUTION SUBJECT TO PERMISSIVE REFERENDUM

NOTICE IS HEREBY GIVEN, that the Town Board of the Town of Babylon, County of Suffolk, State of New York, at a regular meeting thereof held on the 17th day of February 2011, duly adopted a resolution, subject to a Permissive Referendum, an abstract of which is as follows:

RESOLUTION NO. 144 FEBRUARY 17, 2011 REQUESTING THE CONVEYANCE OF A PARCEL TO THE TOWN OF BABYLON FOR TRANSFER TO THE NORTH AMITYVILLE HOUSING REHABILITATION ASSOCIATION (SECTION 72-h, GENERAL MUNICIPAL LAW) WHEREAS, the Town of Babylon is the owner of a parcel of land identified as 18 Juniper Place, Amityville, New York SCTM #0100-168.00- 02.00-039.000; and

WHEREAS, the Town of Babylon is willing to declare this parcel to be surplus Town property which could be transferred to the North Amityville Housing Rehabilitation Association, Inc., a Town designated Community Housing Development Organization, for the purpose of rehabilitation for affordable rental housing; and

WHEREAS, the Town of Babylon has committed funding from HOME funds for the rehabilitation of property for affordable rental housing,

NOW THEREFORE, be it

RESOLVED, that the North Amityville Housing Rehabilitation Association, Inc. requests the Town of Babylon to execute and deliver a quitclaim deed to the North Amityville Housing Rehabilitation Association, Inc. for said property, more particularly described and designated as 18 Juniper Place, Amityville, New York SCTM #0100 168.00- 02.00-039.000, pursuant to Section 72-h of the New York General Municipal Law, for the purpose of transferring the interest of the Town of Babylon in the above described property to the North Amityville Housing Rehabilitation Association,

Inc., for affordable rental housing; and be it further

RESOLVED, that said quitclaim deed issued by the Town of Babylon, pursuant to this resolution, shall contain a reverter clause to the effect that title to the said above described parcel shall revert to the Town of Babylon in the event that the property is not used for the above-described public governmental purpose or in the event that the North Amityville Housing Rehabilitation Association attempts to sell, transfer, or otherwise dispose of or does, in fact, sell, transfer, or otherwise dispose of said subject property without said property being used thereafter for the above described public governmental purpose subsequent to delivery of said deed to the North Amityville Housing Rehabilitation Association, Inc.; and be it further

RESOLVED, that the Supervisor be and he is hereby authorized to execute a deed transferring the property from the Town of Babylon to the North Amityville Housing Rehabilitation Association, Inc.; and be it further

RESOLVED, that the Supervisor be and is hereby authorized to execute an agreement with the North Amityville Housing Rehabilitation Association, Inc. to provide affordable rental housing at the aforementioned location subsequent to the approval of the Town Attorney as to form and content; and be it further

Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent with the provisions of the Local Finance Law. All other matters except as provided herein relating to the serial bonds herein authorized including the date, denominations, maturities and interest payment dates, within the limitations prescribed herein and the manner of execution of the same, including the consolidation with other issues, and also the ability to issue serial bonds with substantially level or declining annual debt service, shall be determined by the Fire District Treasurer, the chief fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such forth and contain such recital, in addition to those required by Section 51.00 of the Local Finance Law, as the Fire District Treasurer shall determine consistent with the provisions of the Local Finance Law. Section 7. The validity of such bonds and bond anticipation notes may be contested only if: a) Such obligations are authorized for an object or purpose for which said Fire District is not authorized to expend money, or b)The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suite or proceeding contesting such validity is commenced within twenty days after the date of such publication, or c) Such obligations are authorized in violation of the provisions of the Constitution. Section 8. This resolution shall constitute a statement of official intent for purposes of Treasury Regulations Section 1.150-2. Other than as specified in this resolution, no monies are, or are reasonably expected to be, reserved, allocated on a long-term basis, or otherwise set aside with respect to the permanent funding of the object or purpose described herein. Section 9. Upon this resolution taking effect, the same shall be published in summary form in the official newspaper of said Fire District for such purpose, together with a notice of the Fire District Secretary in substantially the form provided in Section 81.00 of the Local Finance Law.
